David and his assistant, Jackie, work well together to help you go through the lemon law process. Before getting in touch with them I was very stressed out and the car dealer was of NO help. Everytime I’d explain that a brand new car should not have so many problems they would brush me off. Once David & his team got involved I didn’t have to do much of anything except provide all my receipts related to the lemon car. They also kept in touch with me & updated me with the progress being made. After several months of them dealing with Corporate & me driving a loaner car, I met at the dealership & sold the car back to the car company. I walked away with a check in the amount of the one I paid for the car 9 months earlier. They are friendly, easy to talk with & most importantly do a great job!! Sincerely, Pamela M French

The lemon law process can be confusing and difficult to navigate. Thankfully, this was my first and only experience with it—and my experience with David J. Gorberg was a world apart from what I had gone through with my original law firm. After retaining another lawyer, I often felt confused, left without answers, and treated like a bother when I was simply asking for updates and a path forward. It took more than seven months to get a response, and my lawyer never once picked up the phone. The day before my lawyer finally relayed FCA’s offer, I called David Gorberg for a consultation. In two phone calls and about 30 minutes of conversation, David was more helpful and pleasant than my entire experience with the firm I had hired. He listened, took the time to explain things clearly, and was prepared to step in and take action. When I told him my lawyer had finally responded and shared the offer, David gave me thoughtful advice on how to proceed. He never asked me for anything—he simply took the time to help. If you’re dealing with a lemon law matter and need someone who will listen and explain your options, I highly recommend David J. Gorberg and his team. Thank you, David. When you feel cornered and unsure where to turn, professionals like you can make a world of difference. You and your team are amazing, and if I ever need help again, you’ll be my call.

    Frequently Asked Questions

    What is the Lemon Law?

The Lemon Law is a state law which is defines when a manufacturer has breached its warranty and what the victim is entitled to for such a breach of warranty. The Pennsylvania Lemon Law provides for a Full Refund or a Replacement Vehicle and mandatory Attorney’s Fees and Costs if the consumer prevails.

When Does my Vehicle Qualify under the Lemon Law?

Should the manufacturer fail to abide by it’s obligations under the lemon law you have the statutory right to file suit in court seeking compensation for your claim. The lemon law act provides for payment of all attorney fees and costs should the consumer prevail. Please call our firm to discuss your lemon law rights and how we can assist you under the lemon law.

What Documents do I Need to Prove a Lemon Law or a Breach of Warranty Case?

The most important documents that you should have to Prove a Lemon Law or a Breach of Warranty Case are the repair orders that you are given after your vehicle has been in for repair. Each time you take your vehicle in for repair you should make sure that all the information contained on these documents is correct. For example, you should be sure that all the complaints are written up EXACTLY as you have stated them; that ALL of your complaints on that visit are included; that the “dates in” and the “dates out” are correct; that the mileage is correct; etc. In Pennsylvania, dealers are required under the Lemon Law to give you a copy of all of your repair orders. If you cannot get them yourself, a qualified attorney may be able to issue a subpoena to the dealership to obtain all the documents on your vehicle. Also, if you keep a calendar of appointments which shows when you took the vehicle in to the dealer, this can be helpful in lieu of or in addition to the repair orders.
