New York Lemon Law Refund – David J. Gorberg & Associates wins $193,975.42 refund for a defective 2023 BMW XM Hybrid under the NY Lemon Law.

A client, who owned a 2023 BMW XM Hybrid, purchased in New York with transmission problems, requiring multiple repairs and more than 60 days out of the service, won a full New York Lemon Law refund of $193,975.42 by the New York State Attorney General Lemon Law Program.

New York State Arbitrator ruled in favor of our client, awarding a full New York lemon law refund in the amount of $193,975.42

Despite 7 repair attempts to fix the transmission defects, and more than 61 days out of service, BMW failed to repair it. After receiving notice of a New York Lemon Law claim, BMW refused to repurchase the 2023 BMW XM.

Approximately 18 months  after the consumer purchased the defective 2023 BMW XM, he hired the New York Lemon Law Attorneys of David J. Gorberg & Associates to file a NY lemon law complaint with the New York State Lemon Law Arbitration Program against BMW seeking a full refund.

BMW denied the New York Lemon Law claim, alleging the vehicle was not defective or a lemon.

On April 8, 2024 a New York State Arbitrator ruled in favor of our client and against BMW, awarding a full refund of $193,975.42.

The Problems with the 2023 BMW XM?

Our New York Lemon Law client began experiencing problems with the transmission of his 2023 BMW XM shortly after purchase.

Car (2023 BMW XM) is currently not drivable with same error message… The vehicle was out of service for over 61 days with 7 repair attempts… the consumer continued to have the same problems of slipping gears that rendered the car performance unsafe. Consumer has met the burden of proof that the defect did substantially impair the use, safely…Plaintiff is granted full refund on price of the vehicle.
