Approximately four months after the Maui consumer purchased the defective 2023 Chevy Tahoe, he hired the Hawaii Lemon Law Attorneys of David J. Within the Lemon Law Rights Period, the alleged nonconformity of defective air bag and/or defective safety restraint system had been subject to examination or repair at least three times by the manufacturer, its agents, distributors, or authorized dealers. The Lemon Law Repurchase award included sales taxes, dealer doc fees and various other fees such as vehicle title, and registration fees. In addition to the repurchase award, the arbitrator awarded all attorney fees and costs to be paid by Chevrolet.

Under Hawaii lemon law SCAP rules, refunds must be issued within 30 days following the date of the decision by the Hawaii Department of Commerce and Consumer Affairs, through the State Certified Arbitration Program (SCAP).
