A Hawaii consumer, who owned a 2021 Lincoln Aviator with a defective rear/360 degree camera won a full Hawaii Lemon Law refund of over $77,000 by the State of Hawaii’s Department of Commerce and Consumer Affairs.

Despite five repair attempts to fix the defective rear/360 degree camera, Ford failed to repair it.  After receiving notice of Hawaii Lemon Law claim, Ford refused to repurchase the 2021 Lincoln Aviator.

Approximately one year after the consumer purchased the defective 2021 Lincoln Aviator, he hired the Hawaii Lemon Law  Attorneys of David J. Gorberg & Associates to file a lemon law complaint with the Hawaii State Certified Arbitration Program (SCAP) against Ford seeking a full refund for their client.

Ford denied the claim and argued that the vehicle was not defective. On November 16, 2023 the arbitrator ruled in favor of the consumer, awarding  a full refund of more than $77,000,  and all attorney fees.

The Problems with the Lincoln Aviator?

A few days after its purchase, the 2021 Lincoln Aviator began experiencing problems with the rearview camera, displaying distorted images, a blue/black screen, and pixelating.

Hawaii Lemon Law and State Certified Arbitration Program (SCAP)

Hawaii’s lemon law program is administered by the Hawaii Department of Commerce and Consumer Affairs, through the Hawaii State Certified Arbitration Program (SCAP). Through this program, a consumer may be awarded a refund or a replacement of their motor vehicle if it is determined to be a “lemon”.

Within the Hawaii Lemon Law Rights Period, the alleged nonconformity of Defective rear/360 degree camera in reverse had been subject to examination or repair at least three times by the manufacturer, its agents, distributors, or authorized dealers. Such alleged nonconformity did continue to exist after this period. (HRS § 481I-3(d)(1))

The Lemon Law Repurchase award included sales taxes, dealer doc fees and various other fees such as vehicle title, and registration fees. In addition to the repurchase award, the arbitrator awarded all attorney fees and costs to be paid by Ford.

Under Hawaii lemon law SCAP rules, refunds must be issued within 30 days following the date of the decision by the Hawaii Department of Commerce and Consumer Affairs, through the State Certified Arbitration Program (SCAP).
