December 2, 2024 – A Honolulu, Hawaii resident, who owned a 2022 Hyundai Tucson with a defective air conditioning compressor and hybrid electric battery defects, won a full Hawaii Lemon Law refund of $42,875.00 by the State of Hawaii’s Department of Commerce and Consumer Affairs.
Despite numerous repairs to the 2022 Hyundai Tucson, and out of service for more than 30 days Hyundai refused to repurchase the it.
Two years after our client purchased the defective 2022 Hyundai Tucson, she hired the Hawaii Lemon Law Attorneys of David J. Gorberg & Associates to file a lemon law complaint with the Hawaii State Certified Arbitration Program (SCAP) against Hyundai seeking a full refund.
On December 2, 2024 a Hawaii State Arbitrator ruled in favor of our clients, awarding a full refund of of the purchase price and payment of all attorney fees by Hyundai. The Hawaii Lemon Law Refund was binding on Hyundai.
2022 Hyundai Tucson Hybrid Electric Battery Defects and AC Problems
Our client, a resident of Honolulu, Hawaii, began experiencing problems with the Hybrid Electric Battery and AC systems with her 2022 Hyundai Tucson after the purchase.

Hawaii Lemon Law and State Certified Arbitration Program (SCAP)
Hawaii’s lemon law program is administered by the Hawaii Department of Commerce and Consumer Affairs, through the Hawaii State Certified Arbitration Program (SCAP). Through this program, a consumer may be awarded a refund or a replacement of their motor vehicle if it is determined to be a “lemon”.

Hawaii Lemon Law Result – Consumer Wins Refund
The Hawaii State Certified Arbitration awarded in favor of our clients on December 2, 2024, entitling our clients, the owners of the defective 2022 Hyundai Tucson to a full refund including all attorney fees, under the Hawaii Lemon Law. The arbitrator wrote:
Within the Lemon Law Rights Period, the vehicle was out of service by reason of repair by the manufacturer, its agents, distributors, or authorized dealers for one or more alleged nonconformities for a cumulative total of thirty or more business days. (HRS 481I-3(d)(3)) If any, identify which nonconformities were included in this total number of days: air conditioning compressor and hybrid electric battery defects
The Manufacturer shall repurchase the Consumer’s vehicle and provide a refund to the Consumer…within 30 days of receipt of this Decision.
The Lemon Law Repurchase award included the full purchase price including sales taxes, dealer doc fees, dashboard cover, seat covers, window tinting, road hazard plus protection plan, and registration fees.
In addition to the Hawaii Lemon Law Refund award, the arbitrator awarded all attorney fees and costs to be paid by Hyundai.
Under Hawaii lemon law SCAP rules, refunds must be issued within 30 days following the date of the decision by the Hawaii Department of Commerce and Consumer Affairs, through the State Certified Arbitration Program (SCAP).
